Interviewing Skills in Legal Practice Essay Example | Topics and Well Written Essays - 1500 words

Interviewing Skills in Legal Practice - Essay Example â€Å"They may have been served with a paper stating things that they know to be untrue; they may have been wronged by another† (Sarat & Felstiner, p. 83, 1997). They may consider that they have acted in a befitting manner and, once all the details are uncovered, no sensible individual could oppose that they have been wrongly charged. They may realize that they have acted incorrectly by some means but have a litany of allegations of improvement, justification, and rationalization.   Public speaking is constantly stated as an extremely frightened occasion in investigations. Lawyers have to do a considerable amount of discussion and be at ease communicating in the presence of others, even the transactional legal representative who under no circumstances goes to the courthouse apart from to file real estate papers. Therefore, it is essential to take into account that the prospective customer may have a huge deal of apprehension regarding telling his or her narrative to an unfamiliar person. How to deal with the clients’ preliminary requirement to tell their narrative is something that is handled differently by various lawyers. It is a manifestation of their individual approach and the topic of their practice. There is no exact technique here, even though there are a few incorrect ones, for instance, the lawyer doing the talking for the most part, with lots of inexplicable legal terminology and giving ‘little or no time for follow-up questionsâ€⠄¢ by the prospective client.   Listening is a most important requirement for an interview, and like other abilities can be enhanced with learning and rehearsal. Too many times within these days’ society, what stands for listening is only waiting silently for your turn to have a discussion.

Evaluating Automobile Fuel Essay Example for Free

Evaluating Automobile Fuel Essay The alternatives to liquid fuels are compressed gases and electric power, however, both are viewed as inferior by the automotive industry. The gases are inferior in terms of energy content per unit volume. Electric power may be stored on board a vehicle in a battery or (for a short time) in capacitors. However, batteries are regarded within the automotive industry as substandard compared to liquid fuels in terms of energy stored by unit weight and volume. Furthermore their cost is high, and the manufacture of some battery types involves large quantities of scarce or environmentally-threatening materials including cadmium, lead, lithium, nickel, sodium, sulphur and zinc. According to the already mentioned just-auto report entitled The future of road vehicle fuels – forecasts to 2020 (January 2008), the International Energy Agency’s World Energy Outlook 2007 found that around 230m barrels of oil equivalent are required to meet global demand each day. Of this total, liquids account for the largest share of the 230m barrels (37%) followed by coal (23%) and natural gas (21%), leaving a 19% contribution from nuclear and sustainable sources. Of the liquids, however, transport use accounts for more than half (51%), with the remainder going to industry (32%), residential and commercial (11%) and power generation (6%). The residential and commercial share is mainly accounted for by oil-fired central heating, and the small power generation share by gas turbines running to meet peak loads. It follows that the transport sector share of the world energy market is just over half of 37%, in other words some 19% or just under one-fifth of the total. It should also be borne in mind that the transport sector is itself divided into light-duty vehicles (privately-owned passenger vehicles and light commercial vehicles), heavy-duty vehicles, and other transport applications (aircraft, ships and diesel railway engines). The light-duty and heavy-duty sub-sectors take about 40% each, and the other applications some 20%. The search for improved efficiency in the transport sector must therefore embrace both light-duty and heavy-duty road vehicles.

The Sampling Of Existing Documentation Information Technology Essay

The Sampling Of Existing Documentation Information Technology Essay System analyst uses sampling techniques in order to organize the above documentation. Sampling technique is the process of combing a representative sample of documents, form and records (Bentley, Whitten, 2007). According to these authors there are two commonly used sampling techniques namely randomization and stratification. Randomization is the process of selecting sample data randomly. Stratification is the systematic process to deduct the variance of sampling data. We can have better understanding of the system due to the analysis of existing documents, forms, files related to the current system. JRP is the structured group work meeting to identify, analyze problems and define the requirements of system. JRP is becoming increasingly common in systems planning and systems analysis to obtain group consensus on problems, objectives and requirements (Bentley and Whitten; 2007). JRP can tabulate the facts efficiently in a short time and it can also replace in the place of numerous and separate interviews. JRP contains different participants with each specialized roles to perform structured meeting. JRP participants include sponsor, facilitator, users and managers, scribes and IT staff. Sponsor is an individual in top management, who has full authority to decide who will be participants, time and location of JRP session. The role of facilitator is to lead JRP session, motivate participants, solve conflicts and meet the requirements of meeting during the JRP session. Users in JRP session are responsible for rules and requirement of business, prototype, and satisfactory decisions. An d Managers are responsible for projects, schedules and costs and training requirements. Scribes job is to record everything discussed in the meeting. IT staff responsible for models and documentation concerning with facts during the discussion. JRP is formed different individuals with various roles and covers both in users and in management levels. JRP saves time to develop systems as it is not required one-on-one interviewing of each participant within the organization. When JRP incorporates prototyping as a means for confirming requirements and obtaining design approvals, the benefits of prototyping are realized (Bentley and Whitten; 2007). In this paper we discussed about the seven fact-finding techniques based on studying our text book and some articles. During our assignment, we become to understand that if the system analyst knows details of fact-finding techniques, they can get knowledge of gathering the required information to develop the current system.

E.E. Cummings :: essays papers

E.E. Cummings is characteristically American. He is a famous, well known American author. I found that his writing style is of a stereotypical American. What is it to be stereotypically American? Well I found that one of the main things is that you can say or write whatever you want and not feel threatened about if what your saying is the right thing or not. Also a lot of Americans will use sarcasm. Also you don’t have to come right out and say whatever you mean. Some will talk about something completely different then what they are really trying to say. Cummings used a good amount of sarcasm in his writing. He sort of made fun of things in his poems without coming out and saying it. He also doesn’t just come right out and say what he means. I haven’t been able to figure out many of his poems at all. The things he says just makes no sense at all. Even after analyzing his work I haven’t been able to understand what he means. I think that is one thing that most Americans do in one way or another. Cummings also wrote a large amount of poems that probably would have offended people in one way or another. But freedom of speech is one thing that all Americans have. We can say whatever we want and not have to answer to anyone about it. If we were in another country that freedom of speech isn’t allowed he possibly could have been thrown in jail for some of his writings. He was known for his lack of correct punctuation and capitalization in his writings. Very often he would write his name as "e.e. cummings", not even capitalizing his own name. He basically had his own style of writing things even though they were not written correctly. He never followed any of the rules which might have been one of the reasons he was so remembered. He was born in Cambridge Massachusetts. He grew up there and worked at a mail-order publishing company for a short time. He decided to volunteer for the Norton-Harjes Ambulance group in France. He was imprisoned for three months in a French Detention camp. While being there

FDA and Merck :: essays research papers

The FDA and Merck Vioxx Scandal   Ã‚  Ã‚  Ã‚  Ã‚  In the news recently, many different companies have been recognized for their unethical practices in their company and towards the public. One of these companies is the FDA and Merck. The FDA, the Federal Drug Administration, is one of the most trusted companies in the pharmaceutical market. This company tests different drugs and gives approval for them to be obtainable to the public. Merck is a company that creates these drugs and then has them tested by the FDA for approval. Some of the drugs that Merck has been known for are Singulair for asthma and seasonal allergic rhinitis, Fosamax for osteoporosis, Cozaar/Hyzaar for high blood pressure, Vioxx and Arcoxia for arthritis and pain, Cancidas for infections, Cosopt for glaucoma, Proscar for benign prostate enlargement, and Maxalt for migraines.   Ã‚  Ã‚  Ã‚  Ã‚  Recently, the FDA and Merck have been battling with many facilities and the public over the drug Vioxx. Vioxx was produced to help arthritis pain in patients. The FDA approved the drug that Merck produced and has been in the market for four years, and recently pulled off of it. Evidence is continuing to surface showing the FDA knowingly approved and promoted the drug, and refused to recall it after showing many health risks and deaths because of it. Evidence has also shown Merck trying to hide evidence of heart disease after the FDA has approved it.   Ã‚  Ã‚  Ã‚  Ã‚  After the FDA and Merck has lied to the public and drawn out many health risks because of drugs that they have approved, it is difficult to come up with an idea that will restore the public’s trust towards both companies. The FDA which was already one of America’s most trusted companies in the medicine industry, has lost the faith that customers always had. To regain the trust of the public, the company could have different public announcements to explain the situation and what occurred with the Vioxx scandal.

“A Property Of the Clan” by Nick Enright: Analysis Essay

“A Property of the Clan † unravels the death of a teenage girl at an underage drinking party and explores how the youths handle the situation. â€Å"A Property of the Clan† is not light entertainment, or an easy play to read. It deals with an ugly and disturbing subject, but does so in a thoughtful and sensitive way, acknowledging the brutal reality of violence against women as an unfortunate experience in life. The plot of “A Property of the Clan † is about teenage violence that existed within Australia at the time; an example is that the language and actions teens make are very abusive throughout the play when ever they drink alcohol. The play contains many themes that involved the lifestyle of Australian youth including; Surf culture, mateship, teenage rebellion, peer pressure and partying (Underage Drinking and Drug use). However, A Property of the Clan” centralises on the idea of Mateship, where you are put into a position to do the right thing or betray your friend. Jared is to choose either do the right thing and tell the police who the murderer is or to keep the secret. With supporting themes such as teenage rebellion where the person opposes their parents command, peer pressure is when you are forced to do something because people are basically abusing you to do so otherwise you will be unpopular. Also the theme of partying is quite important to the Australian youth culture, compared to other countries. Australian teens tend to underage drink and abuse drugs more. It also explores the diminished responsibilities of people under the influence of alcohol and the dire consequences of actions linking to the events in “A Property of the Clan”. † A Property of the Clan’s† targeted audience should be about 17 years old and over, whether a less mature person can understand and explore their own ideas and experience or as an adult (or parents) can further understand the surrounding culture their children are in due to the sensitive content. The main characters from “A Property of the Clan † are from the surfing community of Newcastle, Australia. At the beginning of the play you can see the community in the play is quite rough, Ricko, an aggressive boy, is the leader of the group. The other characters always seem to be intimidated by him; the relationship between Ricko and others is interesting because they know that he isn’t a good person, but still ‘hang out’ with him. This links  to the idea of mateship and peer pressure because of Ricko’s violent characteristics. People who watch this play will be influenced by the violence at first, but towards the end of the play, you can see the change of Ricko’s characteristics transform from a â€Å"Hardcore† to week depressed teen when he admitted that he murdered the girl. The language of “A Property of the Clan” contains very Australian typical 1990’s slang, using slang to communicate often, i.e â€Å"Bush pig†, â€Å"Pay out† and â€Å"mate†. Also the swearing is quite intense for a drama play being performed; it contains a lot of swearing and abusive words. Bibiography : Play script ‘ A Property Of The Clan’
